Terms of Service
These Terms of Service (“Terms”) govern your access to and use of totalbattleguide.com, also known as Total Battle Guide, and its websites, Toolkit applications, and related services (the “Services”). By using the Services, you agree to these Terms.
1) Accounts
- You are responsible for keeping your account credentials confidential.
- You are responsible for activity that occurs under your account.
- You agree to provide accurate information and keep it up to date.
2) Acceptable use
You agree not to:
- Attempt to gain unauthorized access to the Services or other users’ accounts.
- Probe, scan, or test the vulnerability of the Services.
- Interfere with or disrupt the Services (including spamming or overloading).
- Use the Services for unlawful activity.
3) Security and notifications
To help protect accounts, we may send security-related emails (for example, password changes, email changes, or suspicious activity alerts). These messages may include details such as IP address, device/browser information, and approximate location derived from IP (which may be inaccurate).
4) Subscriptions, trials, and Tokens
Checkout identifies the plan, currency, price, billing frequency, included benefits, PC allowance, and any trial. Subscriptions renew automatically and charge your selected payment method until canceled. A trial converts to the disclosed paid subscription unless canceled before its stated end. Taxes may apply as shown at checkout. Promotional and complimentary access may have separate eligibility conditions or an expiry.
Toolkit+ Individual permits one active Toolkit PC session; Multi-device permits up to three simultaneously. Toolkit+ applications launched through the same Toolkit sign-in share its slot. Multiple application windows depend on application support. These allowances do not transfer clan ownership, player permissions, or access to another person’s data. The account holder remains responsible for authorized use, and access may not be resold or used to bypass plan limits. Sign out unused sessions through Account → Active Sessions; closing an application may leave its session active.
Included monthly Tokens are shared across the account, not multiplied by PCs, users, or application windows. A plan change does not by itself grant a second monthly allowance. Complimentary application access does not include monthly Tokens unless expressly stated in the grant. Token purchases, allocations, and usage follow the disclosures shown at purchase; Tokens are not cash or a stored bank balance.
You can manage or cancel a paid subscription through Account → Membership and the billing portal, or contact support if you cannot access those controls. Cancellation normally stops the next renewal, with access continuing until the displayed end date. Termination for prohibited uploads follows the immediate cancellation and access-ending rules in Section 6 (Uploaded Content). Upgrades may take effect immediately with a prorated charge; downgrades normally take effect at the next billing period. Review the confirmation before approving a change. Disabling complimentary access does not cancel a separate paid subscription.
Except where checkout expressly provides otherwise or applicable law requires a refund, canceling does not automatically refund a partly used billing period. Statutory cancellation, withdrawal, refund, and faulty-service rights remain available. Contact support for billing errors, duplicate charges, or refund requests.
5) Future prices, plans, and service changes
We may introduce, replace, or retire plans and change future prices, PC limits, Token allowances, and features to reflect operating costs, security needs, or service development. New-customer offers do not automatically change an existing subscription. We do not apply a price increase retroactively to a billing period already paid for.
For an existing subscription, we will provide at least 30 days’ advance notice of a price increase or a material reduction in paid benefits, or longer where required by law, by account email or another durable notice. The notice will explain the change, effective date, and how to cancel before it takes effect. We will obtain renewed consent where required. If required notice cannot be provided before a renewal, the change will apply to a later eligible renewal.
We may temporarily interrupt or change features immediately where reasonably necessary for security, legal compliance, or urgent technical repairs. For permanent discontinuation or a material reduction during a prepaid period unrelated to your breach, we will provide any remedies required by law and an appropriate refund for the unused affected service. We will give reasonable advance notice of planned discontinuation where practicable.
6) Uploaded Content
You are responsible for all images, files, and other content you upload or submit to the Services (“Uploaded Content”). You must have the right to submit that content and use each upload feature only for its stated purpose.
Conquest evidence uploads accept only screenshots of Total Battle Conquest battle reports. Do not upload unrelated images, photographs, memes, advertisements, or any other material through the Conquest evidence upload feature. Screenshots must accurately represent the battle report; fabricated or misleading evidence is prohibited.
Nudity, sexually explicit or sexually suggestive material, pornography, obscene or vulgar content, and unlawful content are prohibited. These restrictions apply to Uploaded Content anywhere in the Services, including material embedded in an otherwise permitted screenshot.
Uploading any image other than a Conquest battle report screenshot through the Conquest evidence upload feature, or uploading any prohibited content anywhere in the Services, will result in termination of your account and immediate cancellation by us of all active subscriptions associated with that account. Paid access ends upon termination, and canceled subscriptions will not renew. A paid subscription does not exempt you from these rules. We may remove or restrict violating content. Any refund or other remedy required by applicable law remains available.
You must not bypass or attempt to bypass an account suspension or termination. This includes registering with a different email address or identity, creating replacement accounts, or using another person’s account to regain access. Any such attempt violates these Terms and will result in a permanent ban on future account creation and use of the Services. Replacement accounts will be terminated and their active subscriptions canceled. If you believe a decision was made in error, contact support for an appeal; do not create or use another account to evade the restriction. You may return only if we expressly lift the restriction.
7) Suspension, termination, and appeals
We reserve the right to restrict features, suspend access, or terminate accounts for violations of these Terms, nonpayment, fraud, spam, harassment, unlawful activity, attempts to bypass access controls or plan limits, or conduct that threatens users or the Services. We may act immediately without advance notice where reasonably necessary to prevent harm, investigate serious abuse, or comply with law. The mandatory termination and subscription-cancellation rules for Uploaded Content in Section 6 apply to those violations. For other cases, we will normally give notice and a reasonable opportunity to resolve the issue.
We may also end a service or account relationship for legitimate operational reasons with reasonable notice. We will explain the reason and available next steps where lawful and practicable. You can ask for review by contacting [email protected]. Suspension is not itself a billing cancellation; you retain access to available billing controls or may contact support to cancel. On permanent termination, we will cancel active subscriptions and stop future subscription renewals. For prohibited uploads, cancellation and the end of paid access are immediate as described in Section 6. Refunds and access to your data remain subject to applicable law, the reason for termination, and our Privacy Policy.
8) Intellectual property and third-party services
The Services and our original content are owned by their respective rights holders. You may not copy, distribute, or reverse engineer protected material except with permission or as allowed by law. Third-party games, trademarks, platforms, payment processors, and content remain the property of their respective owners. Use of our Services does not grant permission to violate a game or platform’s rules. We do not control third-party availability, decisions, or account restrictions.
9) Service disclaimers
We take reasonable care in providing the Services, but cannot guarantee uninterrupted availability, compatibility with every device or future game update, error-free results, or any particular gameplay outcome. Maintain appropriate backups and review important automated results. To the extent consistent with your mandatory rights, the Services are supplied “as is” and “as available,” without additional implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
10) Limits of liability and preserved rights
Where permitted by applicable law, we are not responsible for indirect or consequential losses, lost business profits, lost business opportunities, or losses that were not reasonably foreseeable when the service was supplied. We are not responsible for failures caused solely by third-party services or events outside our reasonable control, except where the law makes us responsible.
Subject to the exceptions below, our aggregate liability arising from the Services is limited to the greater of US $100 or the fees you paid us for the affected Services in the 12 months before the event giving rise to the claim. This cap does not limit refunds or remedies that the law requires us to provide.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any responsibility that cannot lawfully be excluded or limited. Nothing removes mandatory consumer, privacy, or data-protection rights. If an exclusion or cap is not enforceable in your jurisdiction, the applicable law controls. These Terms do not prevent you from making a lawful complaint or bringing a claim.
11) Governing law and changes to these Terms
These Terms are governed by the laws of Connecticut, United States, except that mandatory protections and court rights applicable where you live remain unaffected. No provision requires a consumer to give up a right to use their local courts where that right is protected by law.
We may update these Terms prospectively and will update the effective date. We will give reasonable advance notice of material changes, including the subscription-change notice described above, and obtain consent where required. An update will not retrospectively remove an accrued claim or statutory right. If one provision cannot be enforced, the remaining provisions continue to apply to the extent lawful.
